Proíbe a instalação de fábricas de conservas

Considerando que as indústrias da pesca e da conserva do peixe, das mais importantes do nosso país, precisam e merecem desvelados cuidados para a sua conveniente valorização e progresso;
Tendo em consideração o exposto pela comissão constituída por portaria de 12 de Março do corrente ano para o estudo das conclusões do primeiro Congresso Nacional de Pesca e Conservas, reunido em Setúbal em Dezembro do ano findo, e para o estudo do quanto interessasse ao desenvolvimento de tão importantes indústrias;
Considerando o que sobre pescas tem por várias vezes exposto a Comissão Central de Pescarias;
Considerando que urgente e indispensável é impedir que aumentem os males de que sofrem estas indústrias; e
Usando da faculdade que me confere o n.º 2.º do artigo 2.º do decreto n.º 12:740, de 26 de Novembro de 1926, por força do disposto no artigo 1.º do decreto n.º 15:531, de 9 de Abril de 1928, sob proposta dos Ministros de todas as Repartições:
Hei por bem decretar, para valer como lei, o seguinte:
Artigo 1.º
Até que as estações competentes do Ministério da Marinha emitam o seu parecer, não é permitido o registo de propriedade de novos galeões, cercos ou traineiras destinados à pesca por meio de artes de cercar para bordo.
Art. 2.º
Da mesma forma e até resolução posterior do Ministério da Marinha, a matrícula de artes de pesca de cercar para bordo só é permitida às artes que no ano anterior tivessem sido matriculadas.
Art. 3.º
Nas mesmas condições não é permitido fazer qualquer alteração ou transformação dos galeões, cercos ou traineiras existentes; porém em casos especiais, e depois de ouvidos os respectivos capitães dos portos e comissões locais de pescarias, e mediante parecer favorável da Comissão Central de Pescarias, poderá o Ministério da Marinha autorizar por despacho a realização de qualquer alteração ou transformação.
Art. 4.º
Fica proibido o estabelecimento de novas empresas, individuais ou colectivas, para o exercício da indústria de conservas de peixe, bem como a alienação ou modificação das empresas e das fábricas existentes, enquanto não for publicada a regulamentação desta indústria.
§ único. Excepcionalmente, em casos muito especiais e urgentes, poderão dar-se modificações, quer nas empresas quer nas fábricas actualmente existentes, quando o Ministro do Comércio e Comunicações o autorize por despacho, devendo porém ser sempre primeiro ouvido o parecer da Comissão de Pesca e Conservas, constituída pela portaria de 12 de Março do corrente ano, publicada no Diário do Governo n.º 59, 2.ª série, de 14 do mesmo mês.
Art. 5.º Fica igualmente proibido o estabelecimento de novas fábricas de conserva de peixe enquanto não fôr publicada a regulamentação desta indústria.
Art. 6.º A comissão a que se refere o § único do artigo 4.º deste decreto deverá proceder com a possível brevidade ao estudo do projecto da regulamentação da indústria das conservas de peixe.
Art. 7.º Fica revogada a legislação em contrário, e nomeadamente o decreto com força de lei n.º 15:489, de 19 de Maio de 1928.
Determina-se portanto a todas as autoridades a quem o conhecimento e execução do presente decreto com força de lei pertencer o cumpram e façam cumprir e guardar tão inteiramente como nele se contém.
Os Ministros de todas as Repartições o façam imprimir, publicar e correr.

Considering that the fishing and fish canning industries, among the most important in our country, require and deserve dedicated care for their proper development and progress;
Taking into account the findings presented by the commission established by ordinance on March 12 of the current year, for the study of the conclusions of the First National Congress of Fishing and Canning, held in Setúbal in December of last year, and for the study of all matters of interest for the development of such important industries;
Considering the various submissions made by the Central Commission of Fisheries;
Considering that it is urgent and essential to prevent the worsening of the problems affecting these industries; and
Exercising the authority granted to me by Article 2, No. 2 of Decree No. 12,740 of November 26, 1926, pursuant to Article 1 of Decree No. 15,531 of April 9, 1928, upon proposal from the Ministers of all Departments:
I hereby decree, with the force of law, the following:
Article 1
Until the competent stations of the Ministry of the Navy issue their opinion, the registration of ownership of new galleons, purse seines, or trawlers intended for fishing with encircling gear is not permitted.
Article 2
Similarly, and until further resolution by the Ministry of the Navy, the registration of fishing gear for encircling at sea is only permitted for those gears that had already been registered in the previous year.
Article 3
Under the same conditions, no alterations or transformations of existing galleons, purse seines, or trawlers are permitted; however, in special cases, and after consulting the respective port captains and local fisheries commissions, and obtaining a favorable opinion from the Central Commission of Fisheries, the Ministry of the Navy may authorize by dispatch any alteration or transformation.
Article 4
The establishment of new companies, whether individual or collective, for the exercise of the fish canning industry is prohibited, as is the transfer or modification of existing companies and factories, until the regulation of this industry is published.
§ single.
Exceptionally, in very special and urgent cases, modifications may be made, whether in companies or in currently existing factories, when the Minister of Trade and Communications authorises it by order. However, the opinion of the Commission for Fisheries and Canned Goods, constituted by the order of 12 March of the current year and published in the Government Gazette no. 59, 2nd series, of 14 of the same month, must always be heard first.
Art. 5.
The establishment of new fish canning factories is likewise prohibited until the regulations for this industry are published.
Art. 6.
The commission referred to in the sole paragraph of Article 4 of this decree must proceed as swiftly as possible with the study of the draft regulations for the fish canning industry.
Art. 7.
Any legislation to the contrary is hereby repealed, namely the decree with the force of law no. 15,489, of 19 May 1928.
It is therefore determined that all authorities to whom the knowledge and execution of this decree with the force of law pertain shall observe, enforce, and ensure it is entirely fulfilled as contained herein.
The Ministers of all Departments shall have it printed, published, and enforced.
